My 38x48 building caved in last week. I had lots of peoples things in it. My insurance company is refusing the claim on the building because they consider my use of the building as business. I have let tons of people store things for 20 years and never charged anyone. Does anyone have any advice or experience with this type of situation? It will be appreciated Thanks Brian
Oh they did say my tractor was covered-asked me to get a quote on the same tractor at dealer. $17407, haven't heard back lol |

Basically if the building is insured they should cover all of YOUR personal property and the building to the limits of the policy, exclusions would include any motorized thing not specifically for the use/maintenance of insured property, which means your lawn mowers, snow blower etc. is covered.
Snowmobile, boat, atv, car, etc. is not and any Commercial/Business equipment is not, these items would be covered on their own policy(s). They will not cover other individuals property however the individuals would be covered under their own policy in the same manor your property is covered by your policy. You always need to be careful before making any claim, claiming all as your own would have gotten all covered items taken care of as your personal property under a single deductible. As a side note, unless things have changed a claim goes against you as a claim regardless of the payout, so a $1,000 claim is the same ding as a $100,000 claim. |

I didn't word that right, everyone understands their stuff is not covered, they are refusing to cover my building because I had other peoples stuff in it. They are saying I was using it as a business. I'm having quotes done but it is around a $50,000 hit I imagine

Is the tractor covered under another policy? Does not make sense?? Is it your homeowners policy and this building is on the property??

They say the tractor is covered under homeowners and yes the building is at my house.

Close friend is a SF agent, I will call him and report back. In the meantime I would probably not discuss anything with your agent or adjuster.

my agent told me the same thing! you wont be covered. i had to get another company to insure my new pole barn if a buisness truck or other peoples property are in the building.i also have state farm. good luck with your claim!

Pretty much every time I've stored a car or boat at a friends place it was understood they were not responsible for theft or damage. The stuff needs its own policy. That seems to be the story you're getting from your agent.

No HW they don't want to cover the damage to his building because he had other people's stuff in it,at least that is what I get when I read his post right after Quinners first post

Update: because there were so many buildings down in the area, everyone's claims got switched to the catastrophic department. Starting all over again and there is no problem so far. I'll know more in a week.

I understand Gary. They were also refusing his personal property. It sounds like the burden of proof he was running a business should be on SF. Don't give them any reason to suspect that this time.

They were actually trying to hurry up and settle on the tractor and close the claim. It's going better now, building quote 36000, tractor quote 17500, demo quote 4500 just have to get electrical quote this weekend. I'll know more next week...

Spoke with my buddy who is a state farm agent, he said if you used the building as a commercial property or charged or were reimbursed in any way for the use thereof technically the claim could be denied. He also stated rarely does SF deny claims unless they know or feel very strongly with evidence that there was a misrepresentation by the insured. Hopefully the claim gets paid, in the meantime you probably want to be very cautious what you say, email, etc. to anyone involved. |

Thanks, it is going better now, adjuster coming Monday and I have all the quotes ready. Hopefully by June we will be rebuilt.
